The following is effective 4-1-2007, as approved by the President and the President's Leadership Team
It is the Policy of Yavapai College to provide a safe learning and work environment, free from the potential hazards associated with drug and alcohol use. As such, the College prohibits the unlawful use, possession, production, manufacture, and distribution of alcohol and other drugs and controlled substances. However, alcohol may be served at Yavapai College Foundation sponsored events. With the prior approval of the President, alcohol may also be served at events that support Yavapai College partner institutions. Use of alcohol for educational purposes in laboratory and classroom instruction is permitted
Working under the influence of it gal drugs, intoxicating beverages or other mind-altering beverages substances is expressly prohibited. Employees shall not manufacture, distribute, or possess illegal drugs, intoxicating beverages or mind-altering chemicals or materials in the workplace or during hours of accountability.
In the event that an employee's work performance could be impaired and cause a danger to others in the work area as a result of using prescription or over the counter medication, the employee should report its use to his/her supervisor.
Any employee who is convicted of a criminal drug offense occurring in the workplace shall so notify the Human Resources Office within five days of the conviction. Employees can contact a College-sponsored service which reports on the dangers of substance use and assists employees affected by drug and alcohol abuse.
Authorized Exception to the Policy:
Alcohol may be served at events that are sponsored by the Yavapai College Foundation. The Executive Director of the Foundation must approve by signing an official approval form. The President may approve a one-time (single event) use of alcohol at specific events that are sponsored by partner institutions that present a benefit to the college or the community. Approval will be made only after receipt of a completed approval form. Approval shall be considered under the following criteria: Compliance with local ordinances and state law with regard to licensing of the event; providing adequate public liquor liability insurance; and such other details regarding sponsorship and nature of the event as may be determined by the President to be necessary before granting authority for the event to proceed. Specifically, the President shall ensure that the following minimum criteria are met.
Liability and Indemnification:
a) Any person (or group) possessing, using„ consuming, or furnishing any alcoholic beverages upon the premises or grounds of the College assumes all risk and liability for damage and injuries to persons and/or property which in any way results from such possession, use, consumption or furnishing of alcoholic beverages. The party seeking the approval will indemnify the College for any expense related to any legal claim in addition to assuming all risk and liability for damage and injuries as stated in this section.
b) Insurance: All groups which serve or furnish any alcoholic beverage shall provide evidence of liability insurance as specified by the College that names the State of Arizona, Yavapai College, the college's District Governing Board, and the college's officers, agents, employees, and students as the insured.
c) Legal Age: It shall be unlawful for any person under the legal age as specified by Arizona statutes to have in his or her possession any alcoholic beverage on any YC property.
d) Taxpayer dollars: No taxpayer dollars may be used to purchase alcoholic beverages, insurance, or be used in connection with the service of these beverages.
e) A Security plan shall be approved by the Chief of Campus Safety. An Arizona "Post Certified" officer shall be present during the on-campus event.
f) Consideration of the YC learning and working environment is a priority (i.e., day and time of the event).
g) Only licensed bartenders may serve alcohol at any event.
h) With no exception, YC employees are not permitted to serve alcoholic beverages at any on-campus event.
